Entry to Kingston’s Aquatic & Leisure facilities is subject to our Terms & Conditions.
Terms and conditions apply to this membership in addition to the standard membership terms and conditions.
Declaration
When signing up to a membership, prospective members agree to abide by all the rules, regulations and conditions of Kingston’s Aquatic & Leisure facilities. Prospective members warrant that they are physically and mentally well enough to proceed. Prospective members acknowledge that they will not hold Kingston Aquatic & Leisure or its affiliates, licensees, agents or employees liable for any loss or injury whatsoever they sustain while on the premises subject to my statutory rights. Kingston Aquatic & Leisure management reserves the right to rescind the rights of patrons not complying with the terms and conditions of membership.
Refunds
A change in personal circumstances of the member shall not entitle the member to a refund/credit. All requests for refunds in the first seven (7) days of a new membership shall be honoured in full. These requests must be received in writing. Memberships are not eligible for refund after the first seven (7) days of a new membership, cancellation due to extenuating circumstances may be considered, and cancellation fees will apply. An application must be lodged in writing, accompanied with relevant documentation for evaluation.
Direct debits/scheduled payments
Direct debit fees are debited from a nominated bank account or credit card (Payment Method) throughout the term for the membership fees on a fortnightly basis. Where the direct debit date for payment falls on a public holiday, the nominated Payment Method will be debited on the next business day. You are responsible for providing notice prior to the scheduled direct debit where you wish to update your Payment Method details. It is the responsibility of the member to keep their credit card and bank account details up to date.
A $10 rejection fee may be charged if your Payment Method is declined, this fee is separate from any fees charged by your financial institution. You authorise for any rejection fees to be charged to your Payment Method.
Term memberships
Term membership are contracts for a fixed period (i.e. 12 month contract). The total contract amount is payable in full upfront or via fortnightly direct debit. If a cancellation is approved for extenuating circumstances, cancellation fees will apply. Expiry date will extend in lieu of any suspensions applied to a membership.
No-fixed term memberships
No-Fixed Term memberships renew automatically each fortnight with payments deducted from a nominated bank account or credit card (Payment Method). Members are required to provide written notice two business days prior to the next debit date should they wish to cancel their membership. To cancel a member must submit a written request to active@kingston.vic.gov.au or via the official cancellation process, requests received after rollover has already been completed will not be processed until the following fortnight. A cancelled no-fixed term membership will remain valid until the end of the paid period, no refunds for cancelling part way through the fortnight.
Membership upgrades
A request can be made to update your membership to a higher value category at any time. This will not reset the start date of the initial membership. Once completed this cannot be reversed.
Concession members
Kingston Aquatic & Leisure management has the right to request a member holding a concession type membership to present a valid concession card at any time during the validity period of the membership. It is the responsibility of the member to present valid evidence prior to expiry. Where a valid concession isn’t on file, membership debit will default to the full amount.
RFID Bands
A replacement fee will be applicable for lost or damaged wristbands and fobs. All members must hold an RFID for access.
Suspension
You may voluntarily suspend your membership for a maximum of 12 weeks per 12 months (calendar year). The maximum suspension period is pro rata for term based memberships (i.e. 6-month terms allow for a maximum of 6 weeks). The minimum suspension period at any one time is 7 days and is a cost of $5.00 per week. Suspension will not be backdated unless a medical certificate is provided. Fees will be waived on presentation of a valid medical certificate. Indefinite medical suspensions will not be granted.
If a member has an open-ended certificate they will be required to either nominate a re-activation date or cancel their membership. If an early return from a medical suspension is requested a new medical certificate to support the early return date will be required. Term members will have an extension applied to the term end date, applicable to the suspension period. Members who pay via direct debit receive a prorated fee reduction in lieu of suspension periods.
Introductory offers (new members only)
Introductory offers are a once-off discount, all membership fees revert to standard pricing after offer ends. A new member is classified as someone who has not had a membership with us in the last 6 months. Promotional memberships with discounts or free periods cannot be cancelled, refunded or transferred. A seven (7) day colling off period still applies.
These memberships must be paid in full by the agreed payment method within the term of the membership. Memberships must commence within four (4) weeks of promotion end date. Maximum suspension periods may be altered for promotional membership. Promotional dates are strictly adhered to with no exceptions. No further discounts apply. All other membership Terms and Conditions including Leisure Centre Terms and Conditions of Entry apply.
Exclusion of liability for death or personal injury
To the maximum extent permitted by law, Council excludes liability for any death or personal injury for a breach of condition implied by section 32J or section 32JA of the Fair Trading Act 1999 in relation to the supply of recreational services under this document, which includes where the services are not supplied with due care and skill not reasonably fit for their purpose.
Annual price review
Kingston City Council reviews operations and pricing of the Aquatic & Leisure Centres annually. Members will be notified of planned price changes one (1) month prior to any alterations.
Terms of entry
Members must have their photo taken upon sign up for identification purposes. Memberships are for individual use only and cannot be given to any other person to use. Failure to comply may result in suspension or cancellation of membership.
Change of details
It is the customer’s responsibility to inform Kingston Aquatic & Leisure management of any changes to their account information, including address, email, phone number and concession status. To ensure members are kept up to date with important information regarding their account, we use electronic communication only. A valid email address is required for all accounts, your email address and other contact details will only be used for the provision of information relating to your membership and will not be provided to third parties.
Visual recordings
It is a condition of entry to Kingston’s Aquatic & Leisure facilities that a person will not operate any visual recording equipment in the facility except in accordance with a Visual Recording Agreement made with Council. Any person breaching this condition must immediately leave if directed to do so by a member of staff. Please enquire at the reception desk if you wish to operate visual recording equipment.
Centre operations
Management reserves the right to alter Centre operation hours, programs and terms and conditions as required. No membership administration will be applied for Centre/area closures less than 48 hours. Members will have the option to suspend or temporarily transfer their membership to another Kingston Aquatic & Leisure facility for a closure period greater than 48 hours, the default option will be to transfer the membership unless otherwise notified.
Behaviour
It is a condition of entry to any municipal building, including Aquatic & Leisure Centres, that a person must not interfere with another person’s use and enjoyment of a municipal building or any part thereof no shall any person use indecent, insulting, offensive or abusive language or behave in an indecent, offensive, insulting or riotous way or engage in any rough or boisterous play or conduct whilst in a municipal building or its surrounds. Patrons must follow directions of staff at all times. Failure to comply may result in suspension or cancellation of membership or a ban from the facility with no right to a refund.
Privacy statement
Personal information collected by Council is used for municipal purposes as specified in the Local Government Act 2020. The personal information will be held securely and used solely by Council for these purposes and/or directly related purposes. Council may disclose this information to other organisations if required or permitted by legislation.
The applicant understands that the personal information provided is for the purpose of providing a membership, payment for the membership and membership related services or any other directly related purpose.
The person completing signing up to this membership may apply to Council for access to and/or amendment of the information. Requests for access and/or correction should be made to Council’s Privacy officer.
