1. Conditions
1.1 All memberships are subject to the Leisure Centre Terms and Conditions of Entry.
1.2 Members must not interfere with another person’s use and enjoyment of a municipal building.
1.3 Members are not to use indecent, insulting, offensive or abusive language or behave in an indecent, offensive, insulting or riotous way whilst in a municipal building or its surrounds.
1.4 Failure to comply with aforementioned conditions may result in suspension or cancellation of membership or a ban from the facility with no right to a refund.
1.5 Kingston City Council will provide a minimum of one month notice of any changes to membership terms and conditions, with communication via the email registered on file.
1.6 Returning members who have outstanding debt must pay this in full prior to commencing a membership.
2. Cooling off period
2.1 All memberships (except Learn to Swim memberships) are subject to a 7-day cooling off period and may be terminated by completing a cancellation request in writing.
2.2 Any initial payment will be refunded in full.
3. Member access
3.1 Members must scan their RFID member wristband or fob at the members gate prior to entering the facility and again each time they enter the gym.
3.2 Members (except those under 10 years and Learn to Swim members) are required to have their digital photo taken and stored on their account. Failure to provide a photo or update your information may result in access being restricted until completed.
3.3 If you visit the Centre without a valid membership, we may refuse you entry.
3.4 The membership fob/wristband is the property of each individual member and is not transferable and each member must hold a fob/wristband.
3.5 Memberships are for individual use only and cannot be given to any other person to use. Members who give their membership to other persons to use, may be suspended or cancelled.
3.6 A replacement fee will be charged for a lost or damaged RFID products.
3.7 Active Seniors members have restricted access to facilities between 8am and 4pm, seven (7) days per week. Members who arrive outside these hours will be turned away.
3.8 Off-Peak members have restricted access to facilities between 8am and 4pm on weekdays and during any operation hours on a weekend. Members who arrive outside these hours will be turned away.
3.9 In the event a member did not bring an access band/fob, they will be required to check in at the front desk to gain access. The front desk service reserves the right to deny access.
4. Refunds
4.1 A change in the personal circumstances of the member shall not entitle the member to a refund/credit.
4.2 All requests for refunds in the first seven (7) days of a new membership (except Learn to Swim memberships) shall be honoured in full. These requests must be received in writing.
4.3 Memberships are not eligible for a refund after the first seven (7) days of a new membership, cancellation due to extenuating circumstances may be considered and cancellation fees will apply. An application must be lodged in writing accompanied with relevant documentation for evaluation.
5. Term memberships
5.1 Term Memberships are all memberships with a fixed period, excepting Learn to Swim memberships.
5.2 Term Memberships are for a specific period from the commencement date.
5.3 Total term fee is payable upfront or via scheduled direct debit payments.
5.4 Member agrees to pay all scheduled direct debit payments at agreed payment frequency for the duration of the Term Membership as agreed upon at time of registration.
5.5 Early membership renewals are allowed in some circumstances; however, members cannot hold consecutive memberships exceeding 18 months from the date of renewal.
5.6 Expiry date of membership will extend in lieu of any suspension days applied.
5.7 Cancellation requests require management approval and cancellation fees apply – fee is calculated as 30% of the balance of fees remaining at date of cancellation request, regardless of last day of use. No refunds for unused membership time.
5.8 For cancellation requests on medical grounds or financial hardship, documentation must be provided to support this request – medical certificate or letter from employer.
5.9 Introductory Offer memberships cannot be cancelled or transferred and agreed fees must be paid in full.
5.10 Members who have ongoing debit rejections and ignore attempts made by us to rectify, may have their membership cancelled and will be unable to re-join.
6. No-fixed term memberships
6.1 No-Fixed Term memberships are all memberships which are ongoing in nature, excepting Learn to Swim memberships.
6.2 No-Fixed Term memberships are ongoing in nature and automatically renew.
6.3 Fees are debited monthly from nominated bank account or credit card and will continue until such time the member provides a cancellation request in writing.
6.4 To cancel a member must submit a written request to active@kingston.vic.gov.au or via the official cancellation process, two business days prior to the next direct debit (rollover).
6.5 Cancellation requests received after rollover, will not be processed until the following month.
6.6 A cancelled direct debit remains current until the end of the paid month, no refunds are given for cancellations requested part way through a month.
6.7 Management reserves the right to cancel a membership if fees remain unpaid or overdue.
7. Learn to swim memberships
7.1 Learn To Swim memberships are program specific memberships which include a swimming lesson.
7.2 Learn To Swim No-Fixed Term Memberships are memberships which are ongoing in nature.
7.3 Learn To Swim Term Memberships are memberships with a fixed period.
7.4 Learn To Swim No-Fixed Term Memberships includes unlimited swimming for enrolled students only (all other family members pay regular entry fees outside of lesson days, including non-swim entry).
7.5 Learn To Swim Term Memberships have access to the facility included on the day of the lesson only.
7.6 Access to venues is not available when the Learn To Swim membership is on suspension. Lessons are strictly at the nominated venue only.
7.7 To cancel a Learn To Swim member must submit formal request via the official cancellation process, two business days prior to the next direct debit (rollover).
7.8 Cancellation requests received after rollover, will not be processed until the following fortnight.
7.9 A cancelled direct debit remains current until the end of the paid fortnight, no refunds are given for cancellations requested part way through a fortnight.
7.10 Management reserves the right to cancel a membership if fees remain unpaid or overdue.
7.11 A $25 cancellation fee per family will apply if a Learn To Swim membership is cancelled within the initial 12-month continuous enrolment period. This cancellation fee will be processed in the final direct debit and will be applied when the last student in the family is cancelled from lessons. Providing the student has held a continuous enrolment/membership for a 12-month period, the cancellation fee will not apply.
7.12 Management reserves the right to process any outstanding fees upon cancellation.
7.13 Learn To Swim Term members pay an upfront fee based on the term duration. Members are required to re-book their class during the designated re-booking period each term, if they wish to secure a place for the next term.
7.14 Please notify the Centre prior to the start of the lesson if you are unable to attend.
7.15 If absent for medical reasons, members can apply for a credit upon presentation of a medical certificate, with up to four (4) credits available per term.
7.16 Credits must be applied for within one (1) month of the missed lessons.
7.17 Credits will be applied to the direct debit fortnightly fee. Credit for term-based members can be applied to the next term’s lesson fees and is not redeemable for cash.
7.18 Credits will remain on a member’s account for a maximum period of 12 months.
7.19 Members absent for a reason other than medical certificate are eligible to receive up to two (2) lessons in the form of guest pass (family swim, gym, group fitness, spa/sauna). Maximum two (2) guest passes per participant, per term. Passes have a 3-month expiry).
7.20 Members and children who require nappies (i.e. babies and toddlers) must be appropriately attired in tight fitting swimwear or aqua nappies.
7.21 Members who have had gastro or diarrhoea-type symptoms, should refrain using the pool for at least two (2) weeks.
8. Direct debit payments
8.1 A pro rata amount is required at time of registration.
8.2 Direct debit fees are debited from a nominated bank account or credit card (Payment Method).
8.3 Payments are processed for all members (except Learn to Swim) on a monthly cycle. Learn to Swim memberships are processed on a fortnightly cycle. Customer Service can be contacted at any time to confirm the next debit date.
8.4 Members cannot request to change the date or frequency of processing.
8.5 Payments are processed in-house by Kingston Aquatic & Leisure management and therefore are not completed on weekends or public holidays.
8.6 Bank account and credit card direct debit options are the only accepted payment form – cash payments are not allowed on memberships unless management approval due to a once-off account issue.
8.7 It is the responsibility of the member to keep their Payment Method details up to date. Where possible Kingston Aquatic & Leisure will send SMS reminders relation to credit card expiry dates.
8.8 It is the responsibility of the member to have funds available in their nominated account any time on the day of direct debit processing.
8.9 A $10.00 rejection fee will be charged to your outstanding direct debit amount if your payment is rejected. This fee is separate from any fees charged by the customers’ financial institution.
8.10 Should there be arrears in payments, a member can be contacted via phone, email or SMS and outstanding amount should be paid at Customer Service on next visit or alternately over the phone via credit card. Any outstanding amounts must be settled prior to access to our facilities.
8.11 If fees remain unpaid, and after attempts by us to rectify the arrears, your membership may be cancelled, and details forwarded to the Kingston City Council collections department.
8.12 Members authorise Kingston City Council to process any outstanding amounts on the next direct debit, in addition to standard payments.
9. Suspension for memberships (excluding learn to swim memberships)
9.1 Memberships can be voluntarily suspended at the cost of $5.00 per week.
9.2 Members who have held membership continuously for 2 years or more receive free suspensions.
9.3 Minimum suspension period is 7 days.
9.4 Maximum suspension days allowed (excludes medical):
• 12 weeks every 12 months (calendar year)
• Maximum suspension period is pro rata for Term Memberships (i.e. 6-month terms allow for a maximum of 6 weeks).
• No-Fixed Term Memberships can access up to 26 weeks of suspension per calendar year.
9.5 Suspensions cannot be backdated (unless medical with an accompanying certificate/letter).
9.6 Term Memberships have an extension applied to their membership applicable to the suspension period (this includes council employees via payroll deduction). Members who pay via direct debit at an Aquatic & Leisure Centre receive a prorated fee reduction during their suspension period.
9.7 Medical suspensions:
• Fees will be waived for medical suspensions with a certificate/letter.
• Indefinite medical suspensions will not be granted, if a member has an open-ended certificate, they will be required to nominate a re‐activation date or cancel their membership.
• If an early return from a medical suspension is requested, members are required to obtain a new certificate/letter from the doctor confirming they are authorised to return to physical activity.
9.8 Term Memberships have an extension applied to their membership applicable to the suspension period (this includes council employees via payroll deduction). Members who pay via direct debit at an Aquatic & Leisure Centre receive a prorated fee reduction during their suspension period.
9.9 Suspension credits applied to membership accounts can be used towards future membership payments. Credits will not be refunded in the event a cancellation is requested.
9.10 Membership will become active after specified suspension end date.
10. Introductory offers
10.1 Introductory discount offers are for new members only - A new member is classified as someone who has not had a membership with us in the last 6 months. No further discounts apply.
10.2 Memberships cannot be cancelled, refunded, or transferred. A 7-day cooling off period still applies.
10.3 These memberships must be paid in full by the agreed payment method within the term of the membership.
10.4 Memberships must commence within 4 weeks of promotion end date.
10.5 Maximum suspension periods may be altered for promotional memberships.
10.6 Promotional dates are strictly adhered to with no exceptions.
11. Membership alterations / transfer
11.1 A request can be made to update your membership to a higher value category at any time. Members may upgrade their membership to a higher value category only and pay any applicable fees. Once completed this cannot be reversed.
11.2 Upgrading a Term Membership will not reset the dates of the initial membership.
11.3 Members cannot downgrade a Term Membership, unless for medical reasons with an accompanying certificate.
11.4 Members who wish to downgrade a No-Fixed Term Membership must wait until the end of the paid month; no refunds are given part way through a month.
11.5 A transfer of membership to another person may be considered, request must be forwarded to management for evaluation and approval.
12. Centre operations
12.1 Management reserves the right to alter Centre operating hours, programs and terms and conditions as required.
12.2 On occasions, maintenance is required on plant and equipment which may result in a temporary closure of an area for use. While we aim to minimise any impact on use of an area, failures may occur which are out of our control.
12.3 No membership administration will be applied for Centre/area closures less than 48 hours.
12.4 Members will have the option to suspend or temporarily transfer their membership to another Kingston Aquatic & Leisure facility for a closure period greater than 48 hours, the default option will be to transfer the membership unless otherwise notified. Learn to Swim membership transfer is subject to class availability.
13. Concession discount
13.1 Full list of discounts available can be provided on request at Customer Service.
13.2 A concession discount may be offered on applicable memberships or pass card products for patrons that hold a valid concession card. This physical documentation must be presented at the time of purchase. An image or letter of a concession card is not considered physical documentation.
13.3 A staff member has the right to request valid documentation from any member or person requesting a concession discount and has the right to refuse a discount if valid documentation is not produced at time of purchase.
13.4 Kingston Aquatic & Leisure management has the right to request a member holding a concession membership to present a valid concession card at any time during the validity period of the membership.
13.5 Active Seniors Memberships are based on age, sufficient documentation must be produced to verify date of birth and this information retained on the members profile.
13.6 Where a valid concession isn’t held on file, membership debit will default to the full amount, and the member authorises for the full debit amount to be debited from their account. Refunds will not be provided for any period where the full debit occurs and concession documentation is provided after the debit has been processed.
14. Annual price review
14.1 Kingston Aquatic & Leisure Centres review prices and operations annually and any price rises come into effect on 1st July each financial year.
14.2 Planned price changes are communicated to members via email one month prior to any alteration.
15. Personal details
15.1 It is the customer responsibility to inform Kingston Aquatic & Leisure management of any changes to their account information, including address, email, phone number and concession status.
15.2 All members must provide a valid email address and mobile number, otherwise no membership product can be sold. To ensure members are kept up to date with important information we use electronic communication only.
15.3 Your email address and other details will only be used for the provision of information relating to your membership and will not be provided to third parties.
16. Lockers
16.1 Free lockers are available to all members excluding Learn To Swim – one locker per member.
16.2 Members use their RFID member wristband to allocate themselves a locker on pool deck or in the change rooms. A pin number is also chosen by the member for added security.
16.3 Members must then scan their wristband and enter PIN to re-enter locker.
16.4 Lockers in the gymnasium are set up with a pin.
17. Parking
17.1 Parking restrictions apply at our venues, it is the responsibly of the member to adhere to parking sign and requirements.
17.2 Ample parking is also available on surrounding streets during peak periods.
18. Visual recording
18.1 It is a condition of entry to Kingston’s Aquatic & Leisure facilities that a person will not operate any visual recording equipment in the facility except in accordance with a Visual Recording Agreement made with Council. Any person breaching this condition must immediately leave if directed to do so by a member of staff. Please enquire at the reception desk if you wish to operate visual recording equipment
18.2 No photo or video footage to be recorded without prior consent.
18.3 QR codes located in gym must be scanned, details entered, and rules agreed to, whenever photo or video footage is being taken.
18.4 As per visual recording rules, staff have the right to view footage and delete if deemed necessary.
19. Exclusion of liability for death or personal injury
19.1 To the maximum extent permitted by law, Council excludes liability for any death or personal injury for a breach of condition implied by section 32J or section 32JA of the Fair Trading Act 1999 in relation to the supply of recreational services under this document, which includes where the services are not supplied with due care and skill not reasonably fit for their purpose.
Gymnasium
20. Hygiene, safety, and equipment
20.1 It is recommended that users seek advice from a doctor or medical professional prior to commencing an exercise program. Members identified in their initial consultation as requiring clearance from a doctor, will be required to obtain this prior to commencing their exercise program.
20.2 Seek assistance from a gym instructor prior to using equipment for the first time. Gym instructors may approach members to assist them with technical advice.
20.3 Members are advised to attach the safety clip when using treadmills.
20.4 Show courtesy to fellow users by sharing equipment between workouts and limiting use to single pieces of equipment.
20.5 Users are to always follow directions from staff.
20.6 Gym bags must be stored away and are not permitted in the workout areas.
20.7 Appropriate footwear must be always worn while in the gym, nonslip athletic soles. No open toe sandals, thongs, crocs (or other open back shoes) or barefoot allowed.
20.8 Always wear appropriate clothing, no offensive prints/designs.
20.9 Towels are compulsory and users are required to always carry one during a workout. Management staff reserve the right to deny access and/or ask members to leave who do not have a towel.
20.10 Use cleaning facilities on site to wipe down equipment after use.
20.11 Equipment is to be returned to the correct storage areas after use.
20.12 Food and hot drinks must not be consumed in workout areas.
21. Age restrictions
21.1 The minimum age requirement for gym membership is 14 years old.
21.2 Active Youth Membership 14 to 15 years
21.2.1 Restricts access to some weight-based training classes such as Body Pump
21.2.2 Compulsory fitness consultation prior to using the gym facilities.
21.2.3 Parent/Guardian aged 16 years and over must consent and sign membership form on behalf of the child.
21.3 Active Youth Membership 16 to 17 years has no restrictions.
21.4 Casual gym access anytime is only available to members and patrons 16 years and over.
21.5 Teen Gym sessions for 12 to 15 years old are available at restricted times of Monday-Friday 3.30pm-5.30pm (last entry for sessions is 5pm). These hours are subject to change without notice.
21.6 All Teen Gym participants must have a compulsory fitness consultation before attending sessions.
22. Unstaffed hours
22.1 Gym is unstaffed from 4.00pm on weekends until facility closes at 6.00pm during winter hours & 7.00pm during summer hours. These hours are subject to change without notice.
22.2 During unstaffed hours, emergency buttons can be activated in case of emergency.
22.3 It is recommended that gym users wear the emergency lanyards provided.
22.4 Regular checks of the gym area are conducted by Centre staff during this time.
Group fitness classes
23. General requirements
23.1 All Group Fitness classes require a booking or ticket prior to attending.
23.2 Aquacise, Deep Water Running and Offsite classes require pre-booking (up to 74 hours in advance) via phone or My Active portal.
23.3 No waitlist is available for pre-booked classes – members must check availability with staff.
23.4 All other land-based classes are first in-first served ticket allocation.
23.5 The timetable is reviewed and updated periodically to ensure high service delivery, and we meet the needs of our community. Classes may be changed, added, or removed during these updates according to certain logistics, demand, attendance, and instructor availability.
23.6 Kingston Aquatic & Leisure Management reserves the right to cancel or change a class in cases of high temperatures, low patron numbers or instructor availability. Notice will be provided in advance when feasible.
24. Attending a class
24.1 Minimum age for group fitness classes is 14 years, except Body Pump which is 16 years.
24.2 Class numbers are capped due to room/pool space.
24.3 A ticket is required for all classes to confirm booking and ensure classes aren’t overpopulated. Pre-booked aqua participants will be checked off and given a water-proof wristband for entry.
24.4 Please arrive at least 10 minutes prior to the class commencement to allow time for parking, ticket/wristband collection and to get to the designated program area.
24.5 No late entry to any group fitness classes after advertised class time. If you enter the group fitness class after the warmup has been completed, you may be asked to leave by the instructor for safety reasons.
24.6 Once a class is full or cut off time has passed, customer service staff cannot allocate any tickets. Please be respectful to staff if you have missed your preferred class.
24.7 Where a member is unable to attend a booked class, this must be cancelled in advance of the session. This can be completed via the member portal or by contacting the venue on 9559 7111. This allows others to have a chance to book in for the class.
25. Hygiene, safety, and equipment
25.1 It is recommended participants seek advice from a doctor or medical professional prior to commencing a group fitness class.
25.2 Participants should inform instructors prior to the class commencing if it is their first time, they are pregnant or have any injuries or medical conditions that may affect their exercise ability.
25.3 Participants should cease exercising immediately and inform instructors if they feel uncomfortable or if they suffer an injury.
25.4 For safety reasons, we recommend that you do not leave a class without performing the appropriate cool down and stretch phase as this is important to help prevent potential injury.
25.5 Participants are to always follow directions from instructors. Some classes are pre-choreographed and require participants to follow specific movements during the class.
25.6 Bring a drink bottle and use a towel in all classes. We also recommend that participants bring a mat to Wellness classes (Yoga, Pilates, Body Balance).
25.7 Members are required to wear appropriate clothing and footwear for exercise programs. Wellness programs (Yoga, Pilates, Body Balance) do allow for bare feet.
25.8 Use cleaning facilities on site to wipe down equipment after use.
25.9 Equipment is to be returned to the correct storage areas after use. Food and hot drinks must not be consumed in any classes.
26. Reformer Pilates
26.1 Members must complete a Reformer Pilates induction prior to any use.
26.2 A Premium Wellness membership is required to attend a Reformer Pilates class (instructor led or virtual) through a membership.
26.3 Members are to complete a minimum of three (3) reformer Pilates instructor led classes prior to using completing any virtual sessions.
26.4 Virtual Reformer Pilates will only be accessible outside of face-to-face classes and during staffed hours, subject to availability.
26.5 Members must provide any health information prior to participating in any session and ensure information conveyed complete and accurate.
26.6 Members should not participate in Virtual Reformer Pilates if you have an injury, illness, medical condition, or any other concern that may affect your ability to exercise safely. If you are uncertain about your suitability for exercise, you should seek medical advice before participating.
26.7 Members are responsible for using all equipment correctly and in accordance with any instructions provided. Grip socks must be worn during all Reformer Pilates sessions.
26.8 All participants must comply with facility rules, signage, and staff directions to maintain a safe and respectful environment.
Aquatics
27. General requirements
27.1 No glass or ceramic items are permitted.
27.2 Members and patrons must shower before entering or moving between the Sauna, Steam Room, Spa and Pools.
27.3 No personal grooming is permitted, including shaving, cutting nails, exfoliating, spitting and hair treatments.
27.4 Please report to a staff member immediately should you being to feel unwell.
27.5 Members and patrons must not be under the influence of drugs or alcohol.
27.6 Members and patrons must always follow the direction of staff.
28. Supervision
28.1 Watch Around Water supervision guidelines must be adhered to at all times.
28.2 Parents must remain poolside during Learn to Swim programming to provide supervision to students under 10 years of age.
28.3 A wristband or membership identification band must be displayed at all times when using the spa, sauna or steam rooms.
28.4 Children under the age of 16 years are not permitted to use the spa, sauna or steam rooms.
28.5 Members and patrons supervising children under 10 years are not permitted to use the spa, sauna or steam rooms.
29. Spa, Steam, Sauna
29.1 No glass drink bottles or containers are permitted.
29.2 Essential oils or similar are not permitted. Eucalyptus spray is available on request, as approved by staff.
29.3 Due to the risk of fire, no items should be placed on or near the heating elements.
29.4 Members and patrons must not tamper with the heater or sensors.
29.5 No exercising in the sauna or steam rooms.
29.6 No reading materials are allowed.
29.7 Members and patrons must not use the sauna or steam rooms if you have a medical condition (including pregnant women) without consulting a medical professional and advising staff prior to use.
29.8 Members and patrons must refrain from lying down in the sauna.
29.9 Street shoes are not to be worn, and shoes must not be placed on the seats.
29.10 Electronic items, including phones, tablets and cameras are not to be used.
29.11 Members and patrons must limit their use of these facilities to 15 minutes at a time and should drink plenty of water to avoid dehydration.
29.12 Do not submerge your head underwater.
29.13 Members must sit on a towel at all times in the Sauna.
Privacy Statement
Personal information collected by Council is used for municipal purposes as specified in the Local Government Act 2020. The personal information will be held securely and used solely by Council for these purposes and/or directly related purposes. Council may disclose this information to other organisations if required or permitted by legislation.
The applicant understands that the personal information provided is for the purpose of providing a membership, payment for the membership and membership related services or any other directly related purpose. The person completing signing up to this membership may apply to Council for access to and/or amendment of the information. Requests for access and/or correction should be made to Council’s Privacy officer.
A full copy of our Privacy Policy may be obtained from kingston.vic.gov.au or from one of our Customer Service Centres and Libraries.
